Terms of Service

Welcome to StoryPath. These Terms of Service (“Terms”) govern your access to and use of the StoryPath application (the “App”) operated by StoryPath LLC (“we,” “us,” or “our”).

Please read these Terms carefully before using the App. By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms

By accessing or using StoryPath, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the App.

These Terms constitute a legally binding agreement between you and StoryPath LLC. You must be at least 18 years old to create an account and use the App.

If you are a professional using the App in a professional capacity (such as a speech-language pathologist, occupational therapist, teacher, or educator), you represent that you have the authority to agree to these Terms on behalf of yourself or your organization.

2. Account Terms

Eligibility

You must be at least 18 years of age to create an account. Accounts for children are not permitted — only parents, caregivers, and professionals may create accounts. Child profiles are created and managed by adult account holders.

Account Creation

You must provide accurate, current, and complete information during registration. You agree to update your information to keep it accurate and current.

One Account Per Person

Each individual may maintain only one account. Creating multiple accounts may result in termination of all associated accounts.

Account Security

You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

Account Types

  • Family accounts: For parents and caregivers creating stories for their children
  • Professional accounts: For speech-language pathologists, occupational therapists, teachers, educators, and other professionals working with families

Account Termination

By you: You may delete your account at any time through the App settings. Account deletion will remove your data in accordance with our Privacy Policy.

By us: We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice. We may also terminate accounts that have been inactive for an extended period.

3. Acceptable Use

You agree NOT to use the App to:

  • Upload, share, or create content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Upload content that exploits or endangers children in any way
  • Impersonate any person or entity, or falsely represent your professional qualifications
  • Send spam, unsolicited communications, or malware
  • Attempt to gain unauthorized access to other users' accounts or data
  • Reverse engineer, decompile, or disassemble the App
  • Use the App for any commercial purpose not intended by its design (e.g., reselling access)
  • Circumvent or disable any security features, including edit mode protections
  • Scrape, harvest, or collect user information without authorization
  • Upload content that infringes on the intellectual property rights of others

Violation of these acceptable use policies may result in immediate account termination. We reserve the right to remove any content that violates these policies without prior notice.

4. Content Ownership and Licensing

Your Content

You retain ownership of all content you create using the App, including stories, templates, images, text, and voice recordings. Your content belongs to you.

License to Us

By using the App, you grant StoryPath LLC a non-exclusive, worldwide, royalty-free license to host, store, display, and transmit your content solely for the purpose of providing the App's functionality. This includes displaying your stories, enabling sharing with connected users, and backing up your data.

Shared Content

When you share a story with a professional, you grant that professional a limited license to view and interact with the shared content within the App. You can revoke this access at any time by removing the share.

Marketplace Content

If you publish a template to the community marketplace, you grant other users a license to download and use that template to create their own stories. You can remove your template from the marketplace at any time, but copies already downloaded by other users will remain in their libraries.

Our Content

The App, including its design, code, branding, and default templates, is owned by StoryPath LLC. You may not copy, modify, distribute, or create derivative works of our content without written permission.

Feedback

If you provide feedback, suggestions, or ideas about the App, we may use them without any obligation to compensate you.

5. Subscription Terms

Available Plans

  • Free: Basic functionality at no cost
  • Silver: $4.99 per month (or $29.99 per year)
  • Gold: $7.99 per month (or $49.99 per year)
  • Professional Solo: $9.99 per month (or $84.99 per year)

Prices are subject to change with at least 30 days' notice.

Billing

Subscriptions are billed monthly or annually depending on your selected plan. Payment is processed by platform: web subscriptions use Stripe, iOS subscriptions use Apple In-App Purchase, and Android subscriptions use Google Play Billing. Payment is charged at confirmation of purchase.

Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. You can manage or cancel your subscription: web subscriptions from Settings › Subscription, iOS subscriptions through your Apple account subscription settings, and Android subscriptions through Google Play.

Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. No partial refunds are provided for unused time within a billing period.

Refund Policy

Subscription fees are non-refundable except where required by applicable law. For refund requests, contact us at cameron.lawrence@storypathapp.com.

Downgrade

Upon cancellation or downgrade to a lower tier, content you created with paid features remains accessible in read-only mode. New creation may be limited to your current tier's allowances.

Price Changes

We may change subscription prices with at least 30 days' notice. If you do not agree to a price change, you may cancel before the change takes effect. Continued subscription after a price change constitutes acceptance of the new price.

Free Trials

If a free trial is offered, the trial period and applicable terms will be disclosed before you begin the trial. Trials automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial ends.

6. Limitation of Liability

Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

StoryPath LLC does not warrant that the App will be uninterrupted, error-free, or free of harmful components.

Educational Tool Disclaimer

The App is an educational and therapeutic support tool designed to help create social stories. It does NOT replace professional medical, therapeutic, or educational advice. Always consult qualified professionals for medical, therapeutic, or educational decisions regarding children.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, StoryPath LLC'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

StoryPath LLC IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION.

Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

7. Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Minnesota, United States, without regard to its conflict of law principles.

Informal Resolution

Before filing a formal legal claim, you agree to contact us at cameron.lawrence@storypathapp.com and attempt to resolve the dispute informally for at least thirty (30) days. Most disputes can be resolved through good-faith communication.

Jurisdiction

Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Carver County, Minnesota. You consent to the personal jurisdiction of such courts.

Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

8. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by posting a notice in the App or sending an email to the address associated with your account at least 30 days before the changes take effect.

Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms. If you disagree with any changes, you may delete your account before the changes take effect.

9. Miscellaneous

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and StoryPath LLC regarding your use of the App and supersede any prior agreements.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment

We may assign our rights and obligations under these Terms to another entity in connection with a merger, acquisition, or sale of assets. You may not assign your rights or obligations without our written consent.
